Terms & Conditions

These Terms & Conditions constitute a legally binding agreement between you and Legal Entity Name, a business registered in India with its principal place of business at Registered Address (the "Company", "we", "us"). By placing an order, creating an account, or accessing the digital edition, you confirm that you have read, understood, and agree to be bound by these Terms.

Definitions

"Product" means the digital edition of the book titled The Cognitive Artifact, delivered in Portable Document Format. "Account" means the email-and-password credential pair created by you at checkout. "Site" means this website and all subdomains operated by the Company. "User", "you" means the natural person who registers an Account or purchases the Product.

Eligibility

You must be at least 18 years of age and legally competent to contract under the Indian Contract Act, 1872. By transacting with us you represent that you satisfy these conditions and that all information you supply is true, current, and complete.

Account Registration & Security

Access to the Product requires an Account created with a valid email address and a password of your choosing. We do not operate an email verification step; you are therefore solely responsible for entering an email address that you own and control. An incorrect or inaccessible email address may result in permanent loss of access, and shall not give rise to any claim against the Company.

You are responsible for maintaining the confidentiality of your password and for all activity occurring under your Account. You agree to notify us immediately of any unauthorised use. The Company shall not be liable for loss arising from your failure to safeguard your credentials.

Licence Granted

Upon successful payment the Company grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and read the Product for your own private, non-commercial use. Purchase of the Product constitutes the grant of this licence only; no sale, assignment, or transfer of ownership in the underlying work occurs.

Restrictions

You shall not, and shall not permit any third party to: reproduce, redistribute, resell, sublicense, lend, publicly display, or communicate the Product to the public; remove, obscure, or alter any watermark, copyright notice, or edition marker; share your Account credentials or reader session with any other person; circumvent any technical access control; extract the Product or any substantial part of it for use in training, fine-tuning, or evaluating any machine learning or artificial intelligence system; or use the Product for any unlawful purpose.

Each reader page is watermarked with the purchasing Account's email address. Distribution of watermarked material will be treated as evidence of breach by the Account holder.

Intellectual Property

All content comprising the Product and the Site, including text, typography, layout, illustrations, trade marks, and the title The Cognitive Artifact, is owned by or licensed to the Company and is protected under the Copyright Act, 1957 and applicable international treaties. All rights not expressly granted herein are reserved.

Price, Payment & Taxes

Prices are displayed on the Site at the point of purchase and are inclusive of applicable Goods and Services Tax unless otherwise stated. Payments are collected by Razorpay Software Private Limited acting as our payment gateway. Your use of that gateway is additionally subject to Razorpay's own terms and privacy policy.

The Company reserves the right to revise prices at any time. Any such revision shall not affect orders already confirmed. Where a price has been displayed in error, we may cancel the order and refund the amount collected in full.

Delivery & Refunds

The Product is delivered electronically and immediately, by unlocking the online reader against your Account. No physical goods are shipped. Delivery and refund entitlements are governed by the Shipping & Delivery Policy and the Refund & Cancellation Policy, each of which is incorporated into these Terms by reference.

No Professional Advice

The Product is supplied for informational and educational purposes only. It does not constitute financial, investment, legal, tax, medical, or other professional advice, and no fiduciary or advisory relationship is created by your purchase. See the Disclaimer for the full statement.

Availability of the Service

The Company endeavours to keep the reader continuously available but does not warrant uninterrupted or error-free operation. Access may be suspended without notice for maintenance, security, or reasons beyond our reasonable control, including acts of God, network failure, or the failure of a third-party service provider.

Limitation of Liability

To the maximum extent permitted by law, the Company's aggregate liability arising out of or in connection with the Product, however caused, shall not exceed the amount actually paid by you for the Product. The Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, nor for loss of profit, revenue, goodwill, data, or anticipated savings.

Indemnity

You agree to indemnify and hold harmless the Company, its author, officers, and agents against all claims, damages, costs, and reasonable legal fees arising from your breach of these Terms or your unauthorised use or distribution of the Product.

Suspension & Termination

The Company may suspend or terminate your Account and revoke the licence without refund where it has reasonable grounds to believe you have breached these Terms, in particular the Restrictions clause. Clauses concerning intellectual property, limitation of liability, indemnity, and governing law survive termination.

Amendments

The Company may amend these Terms at any time by publishing a revised version on this page with an updated revision date. Continued use of the Site or the reader after publication constitutes acceptance of the amended Terms.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. The courts at City, State shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, to the exclusion of all other fora.
